Muito interessante a conversa sobre o Regime jurídico da blogosfera.
Só um pequeno comentário sobre os comentários nos blogues: porque não aplicar o princípio de que, desde que eles sejam difamatórios ou de conteúdo ilegal e desde que o autor do blogue tenha sido alertado para os mesmos, só após esse alerta ele poderia ser penalizado se os não tivesse retirado?
Afinal de contas, é o que sucede com os ISPs, segundo o artigo 16º da lei do comércio electrónico:
"1 - O prestador intermediário do serviço de armazenagem em servidor só é responsável, nos termos comuns, pela informação que armazena se tiver conhecimento de actividade ou informação cuja ilicitude for manifesta e não retirar ou impossibilitar logo o acesso a essa informação".
Antes, no artigo 12º, explica-se que eles "não estão sujeitos a uma obrigação geral de vigilância sobre as informações que transmitem ou armazenam ou de investigação de eventuais ilícitos praticados no seu âmbito".
É que um texto num blogue com 100 comentários, a maioria dos quais deixa de interessar ao seu proprietário ou ao conteúdo disponibilizado a partir da primeira dezena, seria obrigado a conhecê-los em detalhe. Seria igualmente obrigado a vigiar todos os comentários que fossem acrescentados em textos antigos.
No limite, é como uma rádio ou TV em directo que, estando a apresentar alguém que difama outrém durante um razoável espaço de tempo, não corte essa emissão.
Limitar à partida os comentários dá - com toda a legitimidade, obviamente - ao responsável do blogue o poder de escrever algo que não tem contraditório imediato, como no direito de resposta. Sim, o ofendido pode criar outro blogue mas será essa a melhor via?

The statute defines "reporter" as "any person regularly engaged in the business of collecting, writing or editing news for publication through a news medium on a full-time or part-time basis." "News medium," in turn, means "any newspaper or other periodical issued at regular intervals whether in print or electronic format and having a general circulation" as well as broadcast media such as radio and television stations. [...]
With the proliferation of blogs, the question "Who is a reporter?" has gained prominence. Is a blogger a "reporter" within the meaning of Illinois' statute on reporter's privilege? The Illinois appellate courts haven't yet addressed that issue.

Searching through searches: New laws may soon govern the use of data mined from Internet searches
U.S. District Court Judge Thomas Ware on March 17 ordered Internet search behemoth Google Inc. to comply with parts of a U.S. Department of Justice subpoena of search records. The judge directed Google to provide 50,000 Web addresses randomly selected from its index to Justice by April 3. But Ware's balanced ruling said the search engine need not share a list of actual search terms entered by Google users, as Justice had requested.
It's likely, says Stephanie Cole, a partner in the Buffalo law firm of Bloom Cole & Shonn LLP, that new laws will be enacted governing the use of data mined from search records. But it's too early to predict whether that legislation will be more or less restrictive than current regulations, and on whose shoulders the burden of protecting user privacy will fall: on the search Web sites; on those, including the federal government, who wish to access individual search records; or on the search-engine users themselves.
"Where these laws are going to fall will depend on the ruling and the public reaction to it," says Cole, who's chair of the Bar Association of Erie County's Intellectual Property, Computer and Entertainment Law Committee.

Aggregate, Download, Blog: Are Newspapers Yesterday's News? daily newspapers will have to strengthen their efforts to attract younger readers, make more imaginative use of the Internet, and develop stories, mostly local in nature, that better meet the needs of readers who have thousands of news and information sources at their fingertips. Perhaps more than anything else, appealing to younger consumers is essential to the future of newspapers, but those readers are more likely to be more attracted by the newspapers' websites than by their traditional print editions. "If you look at data on readership, you can go back 100 years and each generation has read newspapers less than the generation that came before it," according to Gordon. "When I got into the business in the early 1980s, we recognized that younger people read less, but we felt it was a life-stage issue, and that as they got older [and had to pay] mortgages and taxes, they would increase their readership. But that's not the way things occurred. Usage patterns are set by the early 20s and they don't change over time."
Despite the transformation of the newspaper business, not many people think broadsheets and tabloids will disappear. Even if many hard-news stories have become commoditized, daily papers have few competitors in providing thoughtful analysis and opinion. And even in the digital age, there remains a hunger on the part of readers for stories -- told well with powerful narrative force -- that help explain the world they live in. [...]
And a good narrative can hold a reader's attention regardless of whether the medium used is newsprint, a website or podcasting. Says [Michele Weldon, author of Everyman News: How and Why American Newspapers Changed Forever]: "We've got to stop worrying about how the news is delivered."

: In a world where à la carte can describe a way to choose online content, it was only a matter of time until an on- demand news syndication service for audio and video, in addition to text and pictures, landed on the menu.
This weekend, Mochila, an international service that calls itself a media marketplace, will be introduced in Chicago at Nexpo, an annual U.S. newspaper industry conference.
Mochila will be a place where newspapers, magazines, Web sites and broadcasters can sell content to other publications. Initially, Mochila will allow the exchange only of text and photos, but it plans to add audio and video.

La moitié des internautes de 15 à 19 ans ont crée un blog: Les moins de 25 ans et plus encore les 15-19 ans se démarquent ainsi par la perception d'internet comme outil de communication, quand leurs aînés y voient plutôt une source documentaire. Ils savent cependant garder une certaine distance par rapport aux info rmations, aux avis recueillis en ligne. Passé l'aspect convivial et d'échange, les blogs, chats, et autres dialogues sur le web sont loin d'être leur source prioritaire pour se forger une opinion. Ils accordent prioritairement leur confiance aux avis "autorisés", des experts et des médias, et aux avis proches, de parents, amis ou entourage. Dans ce contexte, les quotidiens et les sites d' info rmation sont privilégiés. Ces deux médias arrivent en tête des médias auxquels les jeunes accordent du crédit pour se forger une opinion.

What would a new-era newspaper look like?
First, I think I'd skip the "paper" part. I've visited a lot of newspaper offices, and many of them proudly display the printing presses that produce their product, just as older newsmen often glory in the title of "ink-stained wretch." But their product isn't paper (in fact, for those of us who recycle, the paper is a drawback, not a plus, at least until it's time to pack things for a move). Their product is information. Paper is just an increasingly obsolete delivery platform. It's expensive, and on the way out. Get rid of it, or start a new "paper" without it.
Second, I'd put some of the money I saved by abandoning delivery trucks, printing presses, and the like into hiring reporters and writers, who have been the object of a lot of cost-cutting over the past couple of decades. [...]
Third, I'd stop insulting readers. [...]
Fourth, I'd get readers involved. [...]
The bottom line is that there's plenty of market space for the news business, so long as it sticks to its core competencies of actually, you know, reporting news accurately and well. [...] There's no reason that newspapers can't remain competitive -- no reason, at least, outside their own management.

Abstract: With more than 22 million blogs online, blogs are becoming a media form of their own. While they offer the benefits of marketing products, discussion of specialised topics, and channel for political activism and social change, they present significant political and legal risks. The emergence of blogging has brought with it a range of legal ramifications. Since blogging is a relatively new phenomenon, a substantial body of case law simply does not exist. There is very, very little case law at this point. The biggest problems arise when bloggers reveal proprietary or confidential information, and post contents that defame the person. Increasingly, a number of employees are victims of dooce dodging. This article examines the potential legal liabilities which could arise from blogging.

Mas uma coisa é a actividade reguladora desempenhada por uma entidade acima de toda a suspeita e outra coisa bem diferente é criar uma ERC com competências dúbias e obscuras, formada num ambiente politicamente opaco e com base em critérios de escolha (não apenas do seu presidente como também dos restantes membros) que nos remetem para as piores práticas do arranjismo e clientelismo político-partidário, ainda por cima escudadas no álibi hipócrita da legitimidade parlamentar.
Se juntarmos a isto as nebulosas prescrições do Código Penal sobre o "crime de perigo" ou as cláusulas ínvias sobre o "sigilo das fontes", é lícito perguntar se o poder político não está a utilizar a reconhecida necessidade de regulação dos media como um pretexto grosseiro para a sua domesticação.
É curioso que um Governo tão refractário aos chamados "pactos de regime", mesmo em áreas onde eles seriam porventura desejáveis, tenha chegado com tanta facilidade a um "pacto de regime" secreto (embora despudorado) com o maior partido de oposição sobre a "regulação" (ou o controlo?) da comunicação social. [...]
O que se passa, porém, é que, em vez de contribuir para combater essa deriva, o Governo de que fazes parte - e onde tens uma decisiva responsabilidade política nesta matéria - está precisamente a criar uma caixa de pandora que só favorece a promiscuidade crescente entre o poder político e os media.

craigblog: newspaper/magazine/tv convergence already happening? ... as print media get online and includes video and breaking news, and the tv guys start to deliver print on their sites, how different are they?
Newspapers were maybe daily or weekly, magazines have much longer time frames, but does that matter any more? For that matter, as time proceeds, what distinguishes papers or magazines, maybe just the length of time to develop stories.

Todos os (maus) nomes
Num post assinado por PedroF e afixado num dos vários blogues que se crêem capacitados para ditar regras de bom comportamento moral no jornalismo lê-se o seguinte:
«São também estas coisas que dão mau nome ao Conselho Deontológico do Sindicato dos Jornalistas: façam o download do ficheiro anexo em Word, cliquem nas propriedades do documento, vão ao sumário e descubram que o autor do texto sobre as notícias da Lusa foi o... "Avante!"»
Não se trata de uma coisa que dê mau nome ao Conselho Deontológico, mas sim de uma coisa que não abona muito a favor da inteligência de quem assim pôs a questão.
A conclusão de que o "Avante!" foi o autor do texto do Conselho Deontológico é reveladora de alguma ignorância ou manipuladora má-fé.
A única coisa que se pode concluir é que o ficheiro anexado no site do Sindicato e no qual se transcreve o comunicado do Conselho Deontológico foi teclado por alguém que utilizou um processador configurado para inscrever a palavra Avante no campo de autor.
Sabendo-se que uma das dirigentes do Sindicato dos Jornalistas é redactora do jornal "Avante!", não parece ser necessário um esforço muito grande para entender o que se passou.
Vejam lá se eu me tenho lembrado de copiar o parecer do Conselho Deontológico para o CJ On Line através do meu Word. Ainda aparecia aí o PedroF a dizer que eu tinha sido o autor do parecer sobre a Lusa.
Na verdade, são estas coisas que dão mau nome ao sistema de ensino em Portugal...

As Internet TV Aims at Niche Audiences, the Slivercast Is Born: In the last six months, major media companies have received much attention for starting to move their own programming online, whether downloads for video iPods or streaming programs that can be watched over high-speed Internet connections.
Perhaps more interesting ? and, arguably, more important ? are the thousands of producers whose programming would never make it into prime time but who have very dedicated small audiences. It's a phenomenon that could be called slivercasting.

Online Auteurs Hardly Need to Be Famous: Increasingly, the new, new thing in media is getting paid for the homemade. Reflecting the surge in the popularity of user-created material, both online and traditional media companies are opening their wallets to make sure that the best of it finds its way onto their television shows and Web sites.
Even Yahoo, the nation's most-visited Web site, has signaled a change in its strategy by moving away from creating its own professional content in favor of user-generated material ? and it appears willing to pay for anything its users deem worthy.
All this is part of a trend seeking to turn conventional media business models on their heads in the digital age. Typically, media content was either paid for by consumers in the form of subscription fees or by marketers through advertising. In offering to pay users for creating content, companies like Yahoo are not looking to turn every amateur into a professional so much as acknowledging the growing appeal of homemade material to audiences and hence its value to media businesses.
"At some point in the next six to nine months, this will become competitive," said Michael Hirschorn, executive vice president for original programming at VH1, which, like iFilm, is owned by Viacom.

Tem uns dias mas ainda está actual...
O que disse um: "(...) em Dezembro passado, o Expresso proclamava em primeira página que um milhão de portugueses eram homossexuais. O estudo, como se podia ler nas letras pequeninas da ficha técnica, depara-se contudo com a recusa de resposta por parte da maioria dos entrevistados e a sua amostra não era representativa do universo. Isso não impediu o Expresso de somar homossexuais e bissexuais, chegar aos míticos dez por cento e, depois, extrapolar para os dez milhões de portugueses, como se até os recém-nascidos fossem sexualmente activos.

O que respondeu o outro: O ?Expresso? apenas revelou capacidade de antecipar o debate e de apresentar um estudo, inédito e credível, sobre os hábitos sexuais dos portugueses e o problema da homossexualidade. Fê-lo antes dos outros e de acordo com as regras do bom jornalismo.

Decreto-Lei que aprova o Regime de Taxas da ERC, Entidade Reguladora para a Comunicação Social: Nestes termos, o Decreto-Lei cria a (i) Taxa de Regulação e de Supervisão, que incide sobre operadores de Imprensa, Rádio, Televisão, Cabo, Comunicações Móveis e Sítios Informativos Sujeitos a Tratamento Editorial, a (ii) Taxa por Serviços Prestados, e a (iii) Taxa por Emissão de Títulos Habilitadores para operadores de televisão e radiodifusão.
Contudo, em virtude de o início de funções da ERC ocorrer já no ano em curso, o diploma determina que os operadores apenas suportarão 50% da Taxa de Regulação e Supervisão, relativa ao ano de 2006. Do mesmo modo, em função do cumprimento do Plano Tecnológico, determina-se uma isenção temporária do pagamento de Taxa de Regulação e Supervisão pelos Sítios Informativos Sujeitos a Tratamento Editorial.
